Waves and Waterfalls.co.uk ; Terms and Conditions for staying at (1) Hendre Bolon or (2) ‘Waves’ Polruan.
1. Contract
A rental contract for a short term holiday let only exists between the paying client (you – an individual aged 18 or over) and the Owner of the house at the point that the guest receives confirmation of their deposit payment.
2. Occupancy
No more than five people (in the case of Hendre Bolon) or four people (in the case of ‘Waves’, Polruan) are to occupy the house/stay overnight at any time during the rental period. However we can accommodate one baby by special request. We reserve the right to refuse entry for the entire party if the property’s capacity is exceeded. No sub-letting is permitted.
3. Conditions of your stay
The Owners have set the following conditions on your stay at the accommodation which you are understood to have accepted if you proceed with the booking. You and all members of your party agree:
- to keep the accommodation clean and tidy and leave it in a similar condition as you found it when you arrived;
- to behave in a way at all times while at the accommodation which does not break any law;
- not to use the accommodation for any illegal or commercial purpose;
- not to behave in an anti-social manner, breach the peace or otherwise act in a way which may disrupt or affect the enjoyment of others;
- not to hold events (such as parties, celebrations or meetings) at the accommodation without the advance consent of the Owner;
- Notify us of any damage or breakages and pay for such and/or additional cleaning if requested to do so (see 4 below);
- abide by the pets policy (see 9 below) and follow the countryside code https://www.gov.uk/government/publications/the-countryside-code/the-countryside-code-advice-for-countryside-visitors
4. Damages
We acknowledge that accidents happen so we do not charge a breakages/security deposit as standard in the event that (for example) a glass is broken. However, we ask (and you agree) to notify us immediately of any breakages or damage so that we can repair or replace the broken/damaged item for the next visitors. Please call Helen or Phil.
If we find that there is any breakage or damage which, in our opinion, is more substantial (including damage by any pets you bring), you will be charged. By agreeing to these Terms and Conditions, you are agreeing that we can contact you to recover reasonable costs and that you will pay promptly.
5. Making your booking.
5.1 The party leader: As the person in charge of the party (“the party leader” or “you”), you must be at least 18 years old at the time of booking. By making the booking, you confirm that you are authorised to make the booking and will ensure that you and other party members are aware of and agree to comply with these booking conditions and the conditions of your stay itemised here.
5.2 Pricing: We keep the prices under constant review and the prices of unsold accommodation may be increased or decreased at any time. We may also correct mistakes in the pricing of unsold accommodation at any time. We will confirm the price of your booking when you make it. As changes and mistakes can happen, you must check the price and all other details of your chosen accommodation at the time of booking.
5.3 Disabilities, medical and special requests: If you or any member of your party has any medical issues or disability that may affect your booking, please tell us before you confirm your booking and give us full details in writing as early as possible before you travel. If we are unable to make reasonable adjustments to meet that person’s particular needs, we can refuse or cancel the reservation. If you have any special requests, you must let us know when you make a booking and confirm them in writing, although we cannot guarantee that any request will be met.
5.4 Amendments to bookings more than six weeks before planned stay: If you want to change any detail of your confirmed booking, you must notify us as soon as possible and we will do our best to arrange the changes
Occasonally we need to make changes/improvements to the accommodation and if this is likely to materially affect your stay we will to contact you by phone if reasonably possible in the case of a significant change or by email in the case of a minor change as soon as is reasonably practical. We will explain what has happened and let you know about the change. However, we will have no further liability to you.
5.5 Booking Deposit
A 20% deposit per rental period is required to be paid within 7 days of when the booking is confirmed. The remaining balance will be required six weeks prior to let date (unless a late booking or by special arrangement). If final payment of any outstanding amount is not completed within six weeks of the check-in date, your booking will be automatically cancelled, and any booking fees paid will be forfeited. If booking is made within six weeks of the check-in date, 100% of the payment will be taken upfront.
6. Cancellation
6.1 Cancellation by you: Please note we have a five-week cancellation policy. Should cancellation be necessary, we must be notified as soon as possible, at which point we will endeavour to re-let the accommodation for the period of the booking. If we are successful in securing another booking for the entire period, we will refund any payments made (less a £25 admin fee). If cancellation occurs within five weeks of the check-in date and we cannot re-let the property, then cancellation charges will be incurred as follows :
- 1 week or less 100% of monies paid
- 2 weeks or less 85% of mines paid
- 3 weeks or less 60% of monies paid
- 4 weeks or less 40% of monies paid
- 5 weeks or less 30% of monies paid
Travel insurance with cancellation cover is therefore recommended. If any outstanding payments are not made within six weeks of the check-in date, we are entitled to treat your booking as cancelled and any booking fees paid will be forfeited, and any outstanding payments will be due.
If you have to cancel your booking because of UK government public health measures imposed as a result of the Covid19 pandemic mean it is unlawful to travel to or to make use of the accommodation you booked, you may choose to : (i) transfer your booking to a later date subject to availability – you will have to pay any difference in price if the cost of the new booking is higher or be reimbursed the difference if the cost of the new booking is lower; (ii) request a voucher with a redemption value equal to the amount previously paid by you for the booking or (iii) obtain a refund of the amount already paid by you for the booking. You will have to contact us in order to access these options.
6.2 Part Cancellations If any person(s) in your party needs to cancel, this will not affect the total cost of your booking . No refunds are payable in the event that you cut short your stay.
6.3 Cancellation by us. Unforeseen Circumstances : In the event of unforeseen circumstances, including for example (but not limited to) damage to the property by storm, water ingress, significant problems with utilities, burst pipes or fire, we reserve the right to cancel or alter reservations before or even during a visit. A full refund of the let fee paid will be given, with no further claim against the owners. In such an event, you may request a voucher with a value equal to the amount previously paid by you for the booking .
7. Check-in
Arrival is after 4.00pm. We kindly request check-out by 11.00am please. This allows us to prepare the house for subsequent guests. We ask all guests to leave the house in a clean and tidy condition and to sort their rubbish into the waste/recycling bins provided.
8. Services
Electricity / heating, Wi-fi, TV, bed linens / bedding and towels are all included in the price as does a cleaning cost after your departure which includes disposal of your (sorted) rubbish. There is a plentiful supply of free logs at Hendre Bolon; if using the woodburning stove at ‘Waves’ Polruan, you will need to arrange to bring your own logs/kindling. Instructions for the use of central heating, hot water, kitchen appliances and woodburning stoves are available at the properties.
9. Pets
Due to the compact nature of the ‘Waves’ in Polruan, its high quality furnishings and in consideration of future guests, regrettably, no pets are allowed in this property. Dogs are permitted at Hendre Bolon, but having regard to the high quality furnishings and the wear and tear/additional cleaning required, only one dog is permitted and a cleaning surcharge of £10 will be charged. Dogs must be kept downstairs at all times and off the furniture. Hendre Bolon is located on a working livestock farm; dogs must be kept under close control at all times, preferably on a lead. No liability will be accepted by the Owners for the behaviour of a guest’s dog.
10. Smoking
Smoking is not permitted inside the house. If there is evidence of smoking internally, or if cigar / cigarette ends are left outside, an additional cleaning fee may be charged and deducted from your breakages deposit.
11. Liability
11.1 Personal injury: The Owners accept no liability for any death, personal injury while on holiday loss or damage of guests’ personal property while staying at either property. All reasonable measures have been taken to ensure that the properties are safe (rewired, replumbed, smoke detectors, HETAS certificates, night lighting, fire safety etc) but the use of the properties and its contents is entirely at guests’ risk. Both properties have steep staircases that are not suitable for the disabled or infirm. Outside, the countryside around Hendre Bolon can be challenging; footpaths and waterfalls in the area are notoriously slippery especially in bad weather.
11.2 Disturbance: We cannot be held responsible for noise or disturbance which comes from beyond the boundaries of the accommodation or which is beyond the Owner’s control. If we know about a problem before you arrive, we will contact you to let you know.
11.3 Livestock and dogs: Hendre Bolon is located on a working livestock farm; dogs must be kept under close control at all times, preferably on a lead. The conduct of dogs is entirely the owner’s responsibility.
11.4 Accessing Hendre Bolon: Access to Hendre Bolon is along a narrow, unmade track (see website wavesandwaterfalls.co.uk for more information) which can also be busy with walkers. Please therefore take extreme caution when using the track. We accept no liability for incidents or damage to vehicles using the access track to Hendre Bolon which is not recommended for vehicles with very low clearance or for very large (eg transit) vans.
12. Right of Entry
We reserve the right to enter the property at any reasonable time for maintenance, repairs or inspection or if you break any of these booking conditions.
13. Complaints and suggestions
Please inform us as soon as possible if you have any complaints or suggestions regarding either property to allow us to address such issues promptly.
